Our approach in brief
Personal data is processed only to the extent necessary to run a functional, secure website and to answer your requests. We never sell, rent or exchange your personal data. We process data for these purposes only:
- Ensuring the proper functioning and security of the website.
- Answering your inquiries and providing our yacht charter and event services.
- Understanding how the website is used so that we can improve it.
“Processing” has the meaning given in Article 4 of Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR). When we no longer need your data, we delete it, unless the law requires us to keep it longer.
How we process your data
Contact and quote requests
When you write to us by e-mail, phone or through the contact form, we use the details you provide (for example your name, e-mail address, phone number, dates, group size and message) to answer your request and prepare a quote. Without this data we cannot answer your inquiry in full.
Legal basis: Article 6(1)(b) GDPR, as the processing is needed to respond to your request and to prepare a contract. Retention: we delete your data once your inquiry is fully answered, unless a legal obligation requires us to keep it or a contract results from it.
Bookings and contracts
If you book a charter or another service, we process the data needed to perform the contract, such as contact details, billing details and guest information required for the charter. We may share this data with the yacht owners, crews and partners involved in your booking, only as far as needed.
Legal basis: Article 6(1)(b) GDPR. Retention: for the periods required by tax and commercial law.
Cookies
Our website uses cookies and similar technologies. Cookies are small text files stored by your browser. Some are needed for the site to work. Audience measurement (Google Analytics) and order attribution cookies are set only if you accept them in the cookie banner.
You can accept, deny or customize your choices at any time with the cookie button at the bottom right of the screen. You can also refuse or delete cookies in your browser settings. The steps depend on the browser you use, so please check its help pages. If you block cookies, some functions of the site may not work fully.
Audience measurement with Google Analytics
We use Google Analytics, a service of Google Ireland Limited, to understand how visitors use our website (for example which pages are viewed). IP anonymization is enabled in our settings. The service sets cookies and may transfer data to Google servers, including outside the European Union, only after you accept analytics cookies in the cookie banner.
Legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw at any time with the cookie button. You can also block this measurement with the browser add-on provided by Google. See also the Google privacy policy.
Services that load on our website
Google Maps
We use Google Maps to show our location and provide directions. When you load a page with a map, Google can see your IP address and which website the request comes from, and may store a cookie in your browser. Google may process data on servers in the United States. Legal basis: Article 6(1)(f) GDPR, our legitimate interest in a functional website. See the Google Terms of Service.
Cloudflare Turnstile
To protect our contact form from spam and bots, we use Cloudflare Turnstile, a service of Cloudflare, Inc. When the form loads, the service may collect technical information such as your IP address and browser characteristics to tell humans from automated programs. See the Cloudflare privacy policy. Legal basis: Article 6(1)(f) GDPR, our legitimate interest in protecting the website from abuse.
Fonts
Our typefaces (Cormorant Garamond and Outfit) are hosted on our own website. Your browser does not contact Google to load them.
Social network links
The footer of our website links to our pages on LinkedIn and Instagram. These are simple links: no data is sent to these networks until you click. After you click, the network can record information about your visit, and its own privacy policy applies (LinkedIn, Instagram). This data may be processed in the United States. If you are logged in to your account, the network may link your visit to it, so you may wish to log out first.
Your rights under the GDPR
You have the right to:
- obtain confirmation of whether we process your data and receive a copy of it (Article 15);
- have inaccurate or incomplete data corrected (Article 16);
- have your data deleted (Article 17), or its processing restricted (Article 18);
- receive your data in a structured format and have it transmitted to another provider (Article 20);
- object to processing based on our legitimate interest (Article 21), in particular for direct marketing;
- withdraw any consent you have given, at any time and with future effect (Article 7(3));
- lodge a complaint with a data protection authority. In France this is the CNIL (Article 77).
To exercise these rights, write to charter@ocean5yachts.com. Where we have passed your data to recipients, we inform them of any correction, deletion or restriction, unless this is impossible or requires disproportionate effort.
Jurisdiction and updates
Legal disputes are subject to French law and to the jurisdiction of the courts of Grasse, France, unless mandatory law provides otherwise.
We may update this policy when our website or the law changes. The date of the latest update appears at the top of this page.
